ACFE Board of Regents issue disciplinary actions

Joseph Barbagallo
On June 27, 2012, the ACFE Board of Regents voted to suspend Joseph Barbagallo of Philadelphia, Pa., for two years, with an additional provision that he must complete four hours of NASBA-approved ethics training in addition to his other CPE requirements. (NASBA is the National Association of State Boards of Accountancy.) This decision was supported by a recommendation of the ACFE Board of Review.
The Board of Review's decision was based, in part, on the following: 1) On April 6, 2001, Barbagallo signed a Consent Judgment Order that entitled plaintiffs to entry of judgment for their claims of breach of fiduciary duty, conversion, breach of contract and professional malpractice. 2) On Dec. 5, 1990, Barbagallo signed a Consent Agreement with the Pennsylvania Board of Accountancy that levied a civil penalty against him in the amount of $1,000. 3) Barbagallo failed to disclose both of these matters on his 2007 CFE Exam application that specifically asked if he had ever been subject to an adverse civil judgment or sanctioned by a professional body.
Luis Santiago
On June 17, 2012, the ACFE Board of Regents voted to permanently expel Luis Santiago of Tucson, Ariz. This decision was supported by a recommendation of the ACFE Board of Review, which found Santiago acted as an unlicensed and unauthorized reseller of ACFE products when he placed a listing on eBay stating he had multiple copies of the 2012 CFE Exam Prep Course for sale. The Board of Review found these acts violated Article II of the ACFE Code of Ethics, which states: "A Certified Fraud Examiner shall not engage in any illegal or unethical conduct, or any activity which would constitute a conflict of interest."
